Welcome to Modular Container Solutions. These Terms and Conditions govern your use of our website and the purchase of our modular units and container conversions. By placing an order, you agree to be bound by these terms.
1. Quotations and Pricing
Validity: All written quotations are valid for 7 calendar days due to the volatility of steel prices and transport fuel surcharges in South Africa.
Errors: We reserve the right to cancel orders arising from “obvious errors” (e.g., a R500,000 unit listed for R5,000).
VAT: Unless otherwise stated, all prices quoted are inclusive of 15% VAT.
2. Payment Terms
Standard Units: 100% payment is required via EFT before the unit is dispatched from our depot.
Custom Builds: A 50% non-refundable deposit is required to secure materials and begin fabrication. The remaining 50% balance must be settled and cleared in our account prior to delivery.
Ownership: Legal ownership of the goods remains with Modular Container Solutions until the full purchase price has been paid and cleared.
3. Delivery and Site Risk
Logistics: Delivery is provided by third-party heavy-lifting specialists.
Customer Responsibility: You are responsible for ensuring the site is accessible for a heavy-link crane truck (refer to our Site Readiness Checklist).
Liability: Modular Container Solutions is not liable for damage to pavements, underground pipes, overhead cables, or landscaping if the customer directs the driver onto a surface that cannot support the vehicle’s weight.
Failed Delivery: If a delivery cannot be completed due to poor site preparation, the customer will be liable for a redelivery fee.
4. Customization and Specifications
Bespoke Orders: Modifications are based on approved floor plans. Any changes requested after fabrication has begun will incur additional “Variation Order” (VO) costs.
Standard Tolerances: Please note that container dimensions have standard industry tolerances of +/- 5mm.
5. Warranties and Defects
Structural Warranty: We provide a 12-month structural warranty on the integrity of the steel frame and welding, provided the unit has been placed on a level foundation.
Exclusions: This warranty does not cover damage caused by site subsidence (ground sinking), unauthorized modifications by the client, or “Acts of God” (e.g., floods, lightning).
CPA Compliance: Nothing in this section limits your rights under the South African Consumer Protection Act regarding “Implied Warranty of Quality.”
6. Cancellation and Refunds
Standard Goods: Orders for stock units may be cancelled before dispatch, subject to a 15% administration and handling fee.
Custom Goods: Once a custom build has commenced, the 50% deposit is forfeited upon cancellation to cover material and labor costs.

7. Limitation of Liability
To the extent permitted by law, Modular Container Solutions shall not be liable for any indirect, incidental, or consequential damages (including loss of business profit) resulting from delivery delays or product use.
8. Governing Law
These terms are governed by the laws of the Republic of South Africa. Any legal proceedings shall be conducted in the jurisdiction of the courts in [Your City, e.g., Johannesburg/Cape Town].
