Welcome to AquaCat Container Traders. As a fully registered and experienced provider of container sales, rentals, and custom conversions, we are committed to clear, fair, and transparent business practices. The following Terms and Conditions govern your use of our website and any purchase, rental, or service agreement with us. By engaging with our products or services, you agree to be bound by these terms.
1. Definitions and Scope
- “AquaCat,” “we,” “us,” or “our” refers to AquaCat Container Traders (Pty) Ltd.
- “Customer” or “you” means any individual or entity placing an order, requesting a quote, or using our website/services.
- These terms apply to all sales, rentals, quotations, and website interactions unless expressly superseded by a written contract.
2. Quotations, Pricing, and Orders
- Quotation Validity: All written quotations are valid for 7 calendar days unless otherwise specified.
- Price Fluctuations: Due to market volatility in steel and fuel, prices may change without notice. Prices are only secured once full or deposit payment has cleared.
- Errors and Omissions: AquaCat reserves the right to cancel or amend orders arising from typographical or system errors, including obvious mispricing.
- VAT: All prices include 15% VAT unless otherwise stated.
- Order Acceptance: Orders are subject to acceptance and written confirmation from AquaCat. We reserve the right to decline any order at our discretion.
3. Payment Terms
- Accepted Methods: Payments must be made via EFT, bank-guaranteed cheque (with clearing), or secure online gateway. We do not accept cash.
- Stock Units: 100% payment required prior to dispatch.
- Custom Builds: 50% non-refundable deposit to commence work; balance due and cleared before delivery/loading.
- Rentals: First month and security deposit due before release of rental unit.
- Default: Failure to pay as agreed may result in order cancellation, delayed delivery, or legal action. Legal ownership remains with AquaCat until payment is received in full.
4. Delivery, Risk, and Site Preparation
- Logistics: Delivery may be fulfilled by AquaCat or appointed third-party specialists.
- Site Access: Customers must ensure the delivery location is accessible for heavy-lift vehicles and provide accurate site information. Our Site Readiness Checklist is available for guidance.
- Risk Transfer: Risk passes to the customer upon delivery. AquaCat is not liable for damage to property, underground services, or landscaping if instructed to access areas not suitable for our vehicles.
- Redelivery: If the site is not ready or accessible, the customer is liable for additional redelivery or waiting time fees.
5. Customization, Specifications, and Changes
- Bespoke Orders: Build and modifications are based on mutually approved specifications or floor plans. Late requests for changes may incur Variation Order (VO) fees and extend lead times.
- Tolerances: All dimensions and specifications are subject to standard industry tolerances (+/- 5mm for containers).
- Substitutions: If specified materials or components become unavailable, AquaCat may substitute with equivalent alternatives, notifying the customer first.
6. Warranties, Inspection, and Defects
- Structural Warranty: AquaCat warrants the structural integrity of each container for 12 months after delivery, provided it is placed on a sound, level foundation.
- Exclusions: Warranty does not cover damage due to subsidence, customer modifications, misuse, or natural disasters (“Acts of God”).
- Inspection: Customers should inspect units on delivery. Defects or discrepancies must be reported within 48 hours.
- Consumer Rights: These terms do not affect your statutory rights under the Consumer Protection Act (CPA).
7. Cancellations, Returns, and Refunds
- Stock Units: Orders may be cancelled before dispatch, subject to a 15% handling/admin fee.
- Custom Builds: Deposits for custom units are non-refundable once fabrication has commenced.
- Returns: All returns and refunds are subject to our detailed Returns & Refunds Policy.
8. Limitation of Liability
- To the extent permitted by law, AquaCat shall not be liable for indirect, incidental, or consequential losses (including loss of profit, business interruption, or loss of use) arising from delays, delivery, or product use.
- Our liability for any claim is limited to the amount paid for the specific container or service.
9. Intellectual Property and Website Use
- All website content, images, and documents are the property of AquaCat or its licensors. Unauthorized use is prohibited.
- Website users must not use the site for unlawful, fraudulent, or malicious purposes.
10. Governing Law and Dispute Resolution
- These terms are governed by the laws of the Republic of South Africa.
